Ahmet Sever

He was born in Konya in 1960. Graduated from University of Brussels, Faculty of Political Science. He worked as Milliyet Daily’s Brussels correspondent and representative between 1983 and 1998.

He was in the staff of Mehmet Ali Birand’s “32.Gün” TV show. He worked at BBC Cologne and Voice of Germany. In 1998, he returned to Turkey and worked as news director at Milliyet Daily and CNN Turk. He prepared TV shows about European Union at CNN Turk and TRT.

He worked as President Abdullah Gül’s Principal Consultant of Media, Communication and Public Relations. In 2003, when Gül was serving as Prime Minister, he worked as his key advisor of press and communication. He was the President of Abdullah Gül’s European Union Communication Group between 2004 and 2007. His term in Gül’s staff lasted 12 years.

He resigned after Abdullah Gül’s term ended. He wrote his memories of the term he worked with Abdullah Gül in his book “Abdullah Gül ile 12 Yıl”. Later, in 2018, he put pen to paper for a second book called “İçimde Kalmasın/Tanıklığımdır”.

3 different cases were opened against his book “İçimde Kalmasın/Tanıklığımdır.

He was accused of “insulting the president” by the complaint of President Tayyip Erdoğan. He was requested to be sentenced to, from one year two months to four years eight months of imprisonment.

He was accused of “insulting a public officer” by the complaint of Tekirdağ MP of Justice and Development Party (AKP) and Chairperson of the Parliament Mustafa Şentop. He was requested to be sentenced to, from one year five months 15 days to four years one month of imprisonment.

He was accused of “insulting a public officer” in the case opened by the complaint of Minister of Industry and Technology Mustafa Varank. He was requested to be sentenced to, from one year two months to two years four months of imprisonment.

In total, he was requested to be sentenced to, from three years nine months 15 days to 11 years one month of imprisonment, in the lawsuits opened against his book.

He is released pending trial.

Ahmet Sever - “Publicy Insulting the President” Trial

The book Ahmet Sever wrote about his impressions of the term he served as key press consultant of former President Abdullah Gül, “İçimde Kalmasın/Tanıklığımdır”, was published in 2018.

After the book was published, President Tayyip Erdoğan, made an official complaint to the prosecutor’s office, against the book. The 4-page-complaint, Erdoğan’s attorney Ahmet Özel made to Istanbul Chief Public Prosecutor’s Office on October 31, 2018, included 22 quotations from the book. Complaint claimed that “President was insulted”.

The complaint claimed that the book had accused President Erdoğan of “Judicial Intervention”, “arbitrary and wasteful spending of opportunities and funds of the state”, “bringing down the state”, “ending the legal system”.

It was defended that “the content of the book was statements made with the purpose of gossip without providing any solid evidence”. It was claimed that “Erdoğan’s personal rights, pride and dignity were attacked”. It was also claimed that the sentence “this book will not end here” written in the epilogue of the book “clearly showed that the intentional attacks were to follow”.

Complaint claimed that Sever “had crossed the limits of freedom of expression and press”. Sever was claimed to have “acted in a way to insult, belittle in the eyes of the public, accuse President Erdoğan through press”.

After the complaint was presented, an investigation was launched against Sever.

According to the Turkish Penal Code, in order to open a lawsuit against an individual for “insulting the President”, a permission form the Minister of Justice is required. Necessary ministerial permission to open a lawsuit against Sever was granted on February 4, 2019.

The indictment against Sever was completed on February 4, 2019.

The indictment agains journalist Ahmet Sever was prepared by Press Related Crimes Bureau of Istanbul Chief Public Prosecutor’s Office on February 4, 2019 due to the complaint of President Tayyip Erdoğan. Erdoğan was the “compliant” of the indictment.

The indictment stated that Sever’s book “İçimde Kalmasın/Tanıklığımdır” was published by Destek Publishing House in May 2018 and that the book was sent to the prosecutor’s office on July 17, 2018.

Sentences which were shown as the base of the accusations were as follows:

“We are facing a government, a one-man in fact, that seems books more dangerous than bombs”

“Erdoğan does not have a new discourse about future any more”

“He is mealy-mouthed, he keeps contradicting himself”

“Everything is sacrificed for a man’s hunger for power and authority. Credits and funds, collected with great sacrifice during the early stages, were spent loutishly by the one-man”

“A system was formed in order to keep Recep Tayyip Erdoğan in power. This system, formed to intimidate, frighten, discourage and silence everyone is full of spy gendarme”

“Is it not possible that after starting the road together, Erdoğan left the cause behind and shifted his ground? Does Erdoğan never betray? Why is it that no one in that neighbourhood thinks that those who started the road with Erdoğan, may, in time, be forced to step aside, sold off or in other words betrayed?”

The indictment also included the summary of the written defence statement Sever gave through his attorney. Sever, in his defence, stated that he collected his memories into a book, that the comments and words put in the book were within the scope of freedom of press.

Sever, in the indictment, was accused of “publicly insulting the President” according to the article 299 of the Turkish Penal Code. He was requested to be sentenced to, from one year two months to four years eight months of imprisonment. Sever was also requested to be “bereaved of specific rights” according to the article 53 Turkish Penal Code.

The indictment was approved by Istanbul 2nd Criminal Court of First Instance.

Journalist Ahmet Sever’s trial started with the first hearing at Istanbul 2nd Criminal Court of First Instance on April 4, 2019. It was stated that the official mandate to send Sever’s house abroad was being translated. It was ruled that an official request was to be sent to the Ministry of Justice in order to take Sever’s defence statement abroad.

Second hearing was held on October 10, 2019. Ahmet Sever was represented by his attorney Oya Aydın Göktaş at the hearing whereas Presedent Tayyip Erdoğan was represented by his attorney Ela Ezgi Yelmen. Attorney Yelmen stated that their complaint regarding the book was standing and requested Sever to be punished. Attorney Oya Aydın Göktaş requested to wait the results of the official dispatch to take Sever’s statement abroad. Judge granted the request. Hearing was adjourned.

Third hearing of the case was held on February 13, 2020. Sever was represented by Filiz Aydın. Erdoğan’s attorney Ela Ezgi Yelmen was absent with an excuse. Judge ruled to wait for the completion of the official dispatch to take Sever’s statement abroad. Hearing was adjourned.

Fourth hearing of the case was to be held on May 14, 2020. However, the hearing was adjourned due to the measures taken against the “coronavirus” pandemics in Turkey. Next hearing is set to September 15, 2020.

5. Standing - Sept. 15, 2020


Saat 10:15’te başlaması gereken duruşma, yaklaşık bir saat gecikmeli olarak saat 11.15’te başladı.

Yargılanan gazeteci Ahmet Sever, duruşmaya katılmadı. Duruşmada, Sever’i; avukatı Oya Aydın Göktaş temsil etti.

Daha önceki duruşmalarda, mahkeme; Sever’in duruşmasının yaşadığı ülkede alınması için yazı yazılmasına karar vermişti. Talebe henüz yanıt verilmediği açıklandı.

2020-2021 Adli Yılı’nın başlaması ile birlikte adliyelerde daha önce kaldırılan bir uygulamaya geri dönüldü. Buna göre; savcıların asliye ceza mahkemeleri yargılamalarına katılmalarının önü açıldı. Asliye Ceza Mahkemeleri’ndeki duruşma savcısı uygulamasına 2011 yılında son verilmişti.

Sever’in duruşması da duruşma savcısı ile birlikte görüldü. Duruşma savcısı, eksiklerin giderilmesini talep etti. Sever’in avukatı Oya Aydın Göktaş da Sever’in savunmasının alınmasının beklenmesini istedi.

Göktaş, ayrıca; İçişleri Bakanı Süleyman Soylu’nun akademisyen Prof. Dr. Baskın Oran’ın bir yazısı üzerine yaptığı açıklamayı anımsattı.

Göktaş, “İçişleri Bakanı Süleyman Soylu’nun Baskın Oran’a karşı kullandığı ‘alçak, uşak, edepsiz, düzenbaz’ gibi ifadeler için yapılan soruşturmada takipsizlik kararı verildi. Buna ilişkin asliye hukuk mahkemesinde açmış olduğumuz tazminat davasında, ifadelerin eleştiri özgürlüğü kapsamında kaldığı belirtilerek davanın reddine karar verildi” dedi.

Sever’in, yargılama konusu olan ifadelerinin; bu dosyadaki ifadeler karşısında çok hafif kaldığını dile getiren Göktaş, “Resmi göreve ilişkin tanıklıklarını yazdığı gazetecilik kitabı nedeniyle yargılaması kabul edilemez” ifadelerini kullandı.

Cumhurbaşkanı Tayyip Erdoğan’ın davaya katılma talebine ile ilgili olarak, Aydın; Erdoğan’ın mahkeme tarafından dinlenerek, şikayetinin doğrudan alınması, katılma talebinin bu işlemden sonra değerlendirilmesi gerektiğini belirtti.


Mahkeme; Cumhurbaşkanı Tayyip Erdoğan’ın yargılamaya katılma talebini kabul etti.

Mahkeme, Sever’in savunmasının bulunduğu ülkede alınmasının beklenmesine karar verildi.

Yargılamanın, 3 Aralık 2020 tarihinde görülecek altıncı duruşma ile devam etmesine karar verildi.

Justice and Development Party (AKP) Tekirağ MP and Parliamentary Deputy Speaker Mustafa Şentop, made an official complaint to the prosecutor’s office after the book was published.

In the denunciation, it was claimed that the crime was committed, in the part between pages 208 and 210 titled “Who is the AKP member that said we will send Gül and Davutoğlu in prison” of Sever’s book. In this part was the evaluation of British Financial Times columnist David Gardner’s article, dated April 12, 2017, regarding the constitutional amendment referendum in Turkey on April 16, 2017 .

Gardner in his article had claimed that he had asked former Prime Minister Ahmet Davutoğlu and Former President Abdullah Gül if they had any plans of separating from the ruling Justice and Development Party and form an “opposition” party and his source had responded that “If they had taken a single step, they would be considered Gülenists and thrown in jail”.

Sever, in his book, had claimed that these were Mustafa Şentop’s words.

Due to the complaint of Şentop, Press Related Crimes Bureau of Istanbul Chief Public Prosecutor’s Office launched an investigation against Sever.

The indictment against Sever was completed on November 26, 2018.

“…. I asked to a close friend of his and a friend I trust a lot. He told me ‘I know about it, David told me it was Mustafa Şentop who used these words’ and I wrote about it in my book.”

It was claimed that Sever, “by repeating the phrases from the book on T24 webpage, had committed the crime of insult in a successive manner”.

Summary of Sever’s defence statement, sent through his attorneys, was included in the indictment as well. Sever, in his statement said subject matter words “were based on facts and opinions fitting the reality”. He also stated that Şentop had used his right of reply and made necessary statements to the public. He also said that both the book and the article must be considered within the scope of freedom of expression.

Sever, in the indictment, was accused of “publicly insulting a public officer due to the performance of his public duty”, “in a successive manner” according to the articles 125 and 43 pf the Turkish Penal Code. He was requested to be sentenced to, from one year five months 15 days to four years one month of imprisonment. Sever was also requested to be “bereaved of specific rights” according to the article 53 Turkish Penal Code.

The indictment was approved by Istanbul 2nd Criminal Court of First Instance.

First hearing of journalist Ahmet Sever’s trial, opened due to the complaint of Justice and Development Party (AKP) Tekirağ MP and Parliamentary Deputy Speaker Mustafa Şentop, was held on March 21, 2019 at Istanbul 2nd Criminal Court of First Instance. When Sever’s trial started, Şentop, had left his position as the Parliamentary Deputy Speaker and had become Chairperson of the Parliament.

At the hearing Ahmet Sever was represented by his attorney Filiz Aydın whereas Mustafa Şentop was represented by his attorney Pelinsu Demircan.

Attorney Aydın requested to take Sever’s statement abroad as he was living out of the country.

Şentop’s attorney Pelinsu Demircan, “Our complaint stands. We would like to take part in the case. It is established that the suspect had committed this crime, and also according to the article 247 of the Code of Criminal Procedure (CMK) suspect is a fugitive, therefore we request a capture warrant to be issued against him to prevent the case from being procrastinated and also an official request to be written abroad due to his current address being abroad.“

Judge ruled to send an official dispatch to the Ministry of Justice to take Sever’s statement abroad. Hearing was adjourned.

Second hearing of the case was held on June 20, 2019. Neither of the parties were present. Hearing was adjourned to wait for the result of the official dispatch to take Sever’s statement abroad.

Third hearing was held on October 10, 2019. At the hearing, Şentop and Sever were represented by their respective attorneys. Şentop’s attorney Pelinsu Demircan, said their witnesses were ready and requested them to be listened. Sever’s attorney Oya Aydın Göktaş said “It is not possible to listen witnesses before the suspect is identified and interrogated. Therefore we do not acquiesce to listening the witnesses”.

Judge ruled to listen former AKP Deputy Provincial Chairperson of Istanbul Fatih Tuna as witness. Witness Fatih Tuna, in his statement, said the following:

“At that time I was the AKP Deputy Provincial Chairperson of Istanbul. I was in charge of external relations. Financial Times wanted to interview me because of the referendum. However I sent them to Mustafa Şentop as I knew it was a legal matter. He gave the interview. I was present at the the time of the interview. I read the indictment. Subject matter chat of the indictment did not happen during said interview. This is all I know and saw.”

After that Sever’s attorney Göktaş said “I do not accept the statement of the witness. It is procedurally wrong to listen him, witness is biased and I request to ask the witness whether he spoke English or not and how was he aware of the content of the indictment since it was not read to him during the hearing”.

Witness Tuna stated that he spoke English and said, “I was there to ensure that there was no miscommunication. I knew about the content of the indictment because it was previously written in the press. I did not read the entire indictment, but I know the subject matter.”

Şentop’s attorney Pelinsu Demircan said “Witness is person who was present at the interview and was aware of the matter with all 5 of his senses”.

Hearing was adjourned to wait for the result of the official dispatch to take Sever’s statement abroad.

Fourth hearing was held on February 13, 2020. Hearing was adjourned with the same reason.

Fifth hearing of the case was to be held on May 14, 2020. However, the hearing was adjourned due to the measures taken against the “coronavirus” pandemics in Turkey. Next hearing is set to September 15, 2020.

Minister of Industry and Technology Mustafa Varank made an official complaint to the prosecutor’s office after the book was published. The official complaint letter that made the denunciation was sent to Istanbul Chief Public Prosecutor’s Office by President Tayyip Erdoğan’s attorney Ahmet Özel, too. Özel, made a denunciation for the accusation of “insulting the president” for the same book.

Official complaint, given for Varank, claims that the “insult crime was committed” on the 152nd page of the book with the part titled “Varank: A brave man comes on the stage and throws down the gauntlet”.

It was claimed that Sever, in his book “had started a new thread targeting Varank and in said part written insulting expressions”. It was claimed that with the book, Varank was accused of “judicial intervention”, “arbitrary and wasteful spending of opportunities and funds of the state”, “bringing down the state”, “ending the legal system”.

It was argued that “the content of the book was statements made with the purpose of gossip without providing any solid evidence”. It was claimed that “Varank’s personal rights, pride and dignity were attacked”. It was also claimed that the sentence “this book will not end here” written in the epilogue of the book “clearly showed that the intentional attacks were to follow”.

The indictment against Sever was completed on November 23, 2018.

The indictment against journalist Ahmet Sever was prepared by Press Related Crimes Bureau of Istanbul Chief Public Prosecutor’s Office on November 23, 2018 due to the complaint of Minister of Industry and Technology Mustafa Varank. Varank was the “compliant” of the indictment.

The indictment claimed that on pages between 152 and 167 of Sever’s book “İçimde Kalmasın/Tanıklığımdır” published by Destek Publishing House in May 2018, “unreal” and “incriminating phrases were used to insult through media”.

Subject matter thread was titled: “Varank: A brave man comes on the stage and throws down the gauntlet”. In this part, details of a phone call Varank had with President Tayyip Erdoğan’s daughter were shared. It was claimed that the tape record that allegedly belonged to the said phone call was “correct”. The indictment claimed that “it was unclear how the tape record was obtained”.

The book claimed that Varank “was shown as the superior giving orders to the internet trolls”.

It was claimed that by “showing Varank as the superior giving orders to internet trolls” the accused crime was committed.

Saat 10.15’te başlaması gereken duruşma, yaklaşık bir saat gecikmeyle, saat 11.15’te başladı.

Yargılanan gazeteci Ahmet Sever, duruşmaya katılmadı. Sever’i, duruşmada; avukatı Oya Aydın Göktaş temsil etti.

Daha önceki duruşmalarda, Sever’in savunmasının bulunduğu ülkede alınması talep edilmişti. Talebe, yanıt verilmediği açıklandı.

2020-2021 Adli Yılı’nın başlaması ile birlikte adliyelerde daha önce kaldırılan bir uygulamaya geri dönüldü. Buna göre; savcıların asliye ceza mahkemeleri yargılamalarına katılmalarının önü açıldı. Asliye Ceza Mahkemeleri’ndeki duruşma savcısı uygulamasına 2011 yılında son verilmişti. Sever’in yargılandığı duruşma da duruşma savcısı ile birlikte görüldü.

Duruşma savcısı, dosyadaki eksiklerin tamamlanmasını talep etti. Sever’in avukatı Oya Aydın Göktaş da Sever’in savunmasının yurtdışında alınmasını istedi.


Hakim, Ahmet Sever’in savunmasının yurtdışında alınmasının beklenmesine karar verdi.

Yargılamanın, 3 Aralık 2020 tarihinde görülecek yedinci duruşma ile devam etmesine karar verildi.


Duruşma Öncesi

Koronavirüs pandemisi karşısında, adliyeye girişler tek sıra halinde yapıldı. Giriş kapıları bariyerlerle çevrilmişti.

Girişte, yine pandemi önlemleri kapsamında ateş ölçümü yapıldı.

Duruşmanın yapıldığı salonun önüne bariyer yerleştirilmemişti.

Duruşma salonunun önü, kalabalıktı.

Mahkeme Salonu Koşulları

Duruşma küçük bir salonda görüldü.

İzleyiciler için ayrılan oturma alanındaki sandalyelere, koronavirüs önlemleri kapsamında bant yapıştırılarak kapatılmıştı. Duruşmayı, sadece dört izleyicinin takip etmesine izin verildi.

Duruşmaya Katılım

Duruşmayı; Bağımsız Gazetecilik Platformu (P24), Medya ve Hukuk Çalışmaları Derneği (MLSA), DİSK Basın - İş Sendikası ve Sınır Tanımayan Gazeteciler Örgütü Türkiye Temsiliciği gözlemcileri takip etti.
