Journalist Alptekin Dursunoğlu was born in 1965.
He is the founder and editor-in-chief of Yakın Doğu News webpage.
He wrote the books “Dördüncü Dünya Savaşı ve Orta Doğu”, “Stratejik İttifak Türkiye İsrail İlişkilerinin Öyküsü”, “Suriye’de Elde Var Sıfır”, “Suriye’de Vekalet Savaşı” and “Yeni Osmanlı’nın Ortadoğu’su”.
Dursunoğlu was accused for the publications he made in his social media account after the run-in where Turkish soldiers were killed during the Turkish military operation in Idlib, Syria. He was taken into custody within the scope of the investigation. On February 29, 2020, he was arrested with the accusation of “publicly provoking hatred and hostility in public in a successive manner”. He was taken to Silivri Prison.
The indictment against him was prepared one day after his arrest. He was accused for his social media posts. He was accused of committing the crime of publicly provoking hatred and hostility in public in a successive manner.” He was requested to be sentenced to from 1 year 3 months to 5 years 3 months of imprisonment.
At the first hearing of the case on March 16, 2020, he was sentenced to 50 days of imprisonment for “praising an offence and the offender”. Imprisonment sentence was converted to a thousand TL fine. With the fine he was released.
Journalist Alptekin Dursunoğlu was taken into custody on February 29, 2020.
One day before he was taken into custody; Turkish soldiers in Idlib, Syria were attack, 33 soldiers had lost their lives. After the attack, access to some webpages and social media platforms was slowed down. Ministry of Internal Affairs announced that, regarding the attack, “an investigation was launched against those that were making provocative publications”.
Dursunoğlu announced his arrest on his own social media account. He was taken to the police Istanbul Police Headquarters. It was stated that the investigation against him was launched for his social media posts regarding the developments in Idlib, Syria.
He was taken to the Istanbul Courthouse in Çağlayan on March 1, 2020. After giving statement at the prosecutor’s office, he was forwarded to the court. He was requested to be arrested. He was arrested the same day buy Istanbul 8th Criminal Court of Peace with the accusation of “publicly provoking hatred and hostility in public”. He was taken to Silivri Prison.

• Tweet that includes the sentences “Instead of questioning the situation that, hope of overthrowing the regime in Syria behind USA, left the country in; these ox herds are presenting buying F-35’s from USA and fighting Syria as a solution.” on February 18, 2020.
• Tweet that “showed a video, which had the description that translates to ‘hunting terrorists and Turkish tanks in Idlib’” on February 22, 2020.
• Tweet that includes the sentence “Groups supported by Turkey, launched a wide military operation against the Syrian army in south of Idlib” on February 29, 2020.
The indictment claimed that Dursunoğlu, with his posts, “was showing, the presence of Turkish military in Syria as a ‘terrorist activity’”. The word “ox herds” that took place among Dursunoğlu’s posts, was claimed to have “insulted the decision-making authorities of our country”.
Prosecutor Belen claimed that Dursunoğlu, with these posts, “was provoking hatred and hostility in a portion of public against decision-making authorities of the country and the military troops.”
Dursunoğlu was accused of “publicly provoking hatred and hostility in public” in a successive manner according to the article 216/1 of the Turkish Penal Code. He was requested to be sentenced to from 1 year 3 months to 5 years 3 months of imprisonment.
Dursunoğlu was also requested to be “bereaved of specific rights” according to the article 53 Turkish Penal Code.
The indictment against journalist Alptekin Dursunoğlu was prepared one day after his arrest. The indictment was accepted by Istanbul 49th Criminal Court of First Instance 3 days after its preparation.
First hearing of the case was held on March 16, 2020. Dursunoğlu was not brought to the hearing. He joined the hearing through Audio and Video Information System (SEGBİS).
Dursunoğlu in his defence statement, regarding the post about the Attempted Coup at July 15th, said that “first of all, that day, they announced it as a military coup and I was trying to explain that this could not be a coup of Turkish Armed Forces. It was only limited with Istanbul and Ankara. However the coup at September 12 (1980) was done throughout the country.” Regarding his posts about the developments in Idlib, Syria he said “his purpose was to make news” and “it was the translation of the news reported in the Arab press”.
Following that Dursunoğlu’s attorneys took the stand and requested his acquittal.
The court reached a verdict at the first hearing.
The indictment had requested Dursunoğlu to be punished for the accusation of “publicly provoking hatred and hostility in public”. The judge ruled him to be sentenced for the accusation of “praising an offence and the offender” regulated by the article 215/1 of the Turkish Penal Code. Within this scope Dursunoğlu was sentenced to 60 days of imprisonment. After a “good conduct abatement” the sentence was reduced to 50 days. This 50 days of imprisonment sentence was then converted to a thousand TL of fine.
With the decision, Dursunoğlu, who was being kept at Silivri Prison, was released.

Gazeteci Alptekin Dursunoğlu, duruşmaya getirilmedi.
Duruşmanın geç başlaması, gazeteci Dursunoğlu’nun tutuklu bulunduğu cezaevinden duruşma salonuna getirilmesine bağlandı. Mahkeme hakimi, Dursunoğlu’nun duruşmaya getirilmesi için cezaevine yazı yazdıklarını, ancak bilgileri olmadığı halde, duruşmaya getirilmeyerek cezaevinde Ses ve Görüntümü Bilişim Sistemi (SEGBİS) aracılığıyla hazır edildiğini bildirdi.
Duruşmanın başında mahkeme hakimi, corona virüsü nedeniyle aldıkları önlemleri anlattı. Bu sırada Dursunoğlu’nun avukatlarına, “Biz tedbir alırken, bu kadar kişinin duruşmayı izlemeye gelmesi sağlıksız. Anne ve babası gelseydi yeterli olurdu” dedi.
Duruşma kimlik tespitiyle devam etti.
Dursunoğlu, SEGBİS aracılığıyla bağlanarak savunma yaptı.
İddianameye konulan 15 Temmuz 2016’daki askeri darbe girişimine dair paylaşımına ilişkin, “Birincisi, o gün darbeciler, darbenin TSK tarafından yapıldığını söylüyordu. Bende yazımda bunun TSK darbesi olamayacağını anlatmaya çalıştım. Bu sadece İstanbul ve Ankara ile sınırlıydı. Ancak, 12 Eylül darbesi tüm il ve ilçelerde uygulandı” dedi.
Dursunoğlu, Suriye’nin İdlib kentindeki gelişmelere ilişkin paylaşımlarının ise “haber amaçlı olduğunu” ve “Arap basınında yer alan haberlerin çevirisi olduğunu” söyledi.
Daha sonra söz alan Dursunoğlu’nun avukatı Gürkan Biçen, “İddia makamı, olayı kendine göre yönlendirmiştir. Somut deliller yoktur. Bize göre müvekkilimizin beraat etmesi gerekiyor. Somut bir fiil yoktur, suç yoktur” dedi. Biçen, savunmalarını içeren dilekçeyi yazılı olarak mahkemeye sunduklarını belirtti.
Avukat Kemal Aytaç da, “Corona virüsü gelip geçicidir ama düşünce ve ifade özgürlüğü değil. Burada yargılanan düşünce ifade özgürlüğüdür. Müvekkilimizin beraatini talep ederiz” dedi.
Avukat Özlem Burçin Şahan da beraat talebinde bulundu.
Son sözü sorulan Dursunoğlu da beraatini talep etti.
Mahkeme hakimi duruşmaya ara vermeden kararını açıkladı.
İddianamede, Dursunoğlu’nun; “halkı kin ve düşmanlığa alenen tahrik etmek” iddiasıyla cezalandırılması istense de, mahkeme hakimi, Türk Ceza Kanunu’nun 215/1 maddesinindeki “suçu ve suçluyu övme” suçlamasıyla cezalandırılmasına hükmetti.
Bu kapsamda Dursunoğlu’na 60 gün hapis cezası verildi. “İyi hal” gerekçesiyle ceza, 50 güne indirildi. Verilen 50 günlük hapis cezası da bin TL para cezasına çevrildi.
Kararla birlikte Silivri Yüksek Güvenlikli Kapalı Cezaevi’nde tutuklu bulunan Dursunoğlu tahliye edildi.
Adliye girişinde gazeteciler ve izleyiciler X-Ray cihazından geçirildi. Duruşmanın görüleceği koridorda güvenlik bariyeri bulunmuyordu. Corona virüsüne karşı önlemler kapsamında bazı duruşmalar ertelenmişti. Bu yüzden adliyenin yoğunluğu da azalmıştı.
Mahkeme Salonu Koşulları
Mahkeme salonu, Çağlayan Adliyesi’ndeki küçük salonlardandı. Seyirciler için 10 kişilik yer ayrılmıştı. Duruşma salonu temiz ve havalandırılmıştı.
Duruşmayı; P24, Medya ve Hukuk Çalışmaları Derneği (MLSA) ve Türkiye Gazeteciler Sendikası (TGS) izledi.
Adliyedeki yoğunluk, coronavirüs nedeniyle önceki günlere göre oldukça düşmüştü. Adliye kapılarında kuyruk oluşmazken, duruşma salonu kapılarında bulunan listelerde de sadece tutuklu yargılamaların olduğu dava dosyaları yazıldı. Bazı duruşma salonlarında da corona virüse dair uyarı ve bilgilendirme yazıları asıldı.
Duruşmada olağanüstü bir durum yaşanmadı.
