Eren Erdem

Eren Erdem is a journalist and writer. He is also a former CHP MP. In the beginning of the 2000’s, he launched a youth project called “Milli Kurtuluş Platformu” (National Salvation Platform). He was the Editor-in-Chief of the Karşı newspaper. He penned several books. He was elected as a member of parliament in the general elections of June 2015 and November 2015.

Fahri Tosun, a prosecutor from the İstanbul Chief Public Prosecutor’s Office, issued an indictment against Erdem on charges of “aiding and abetting an organization knowingly and willingly, although he does not belong to the structure of that organization” ( TPC 220/7) and “violating an investigation’s confidentiality by disclosing the identity of an anonymous witness” on May 7, 2018.

In the indictment it was claimed the Karşı newspaper was a media operation of the FETÖ/PDY [Fethullahist Terrorist Organization/Parallel State Structure - The followers of Fethullah Gülen, an Islamist living in self-imposed exile in the US that is accused of orchestrating a 15th of July coup attempt. The Turkish government declared FETÖ as a terrorist organization, and was approved by Turkish courts in 2016]. It was claimed that the newspaper was founded for creating a perception after the Dec. 17-25, 2013. Dec. 17-25 was a series of investigations against businessmen, bureaucrats, managers of Halkbank, public officials and politicians at several levels. They were investigated under the charges of “bribery, malpractice and collusive tendering.” The prosecutors who conducted the investigations were later charged for being members of FETÖ/PDY.

The İstanbul 35th High Criminal Court accepted the indictment on May 21, 2018.

Erdem was taken into custody at his home in Ankara on June 29, 2018, and was brought to İstanbul. After his testimony, the İstanbul 35th High Criminal Court ruled to detain Erdem on June 29, 2018.

The İstanbul 23rd Heavy Penal court accepted the indictment about the Karşı newspaper’s owner and journalists which was shut down. The case file had been sent to Istanbul Regional Court of Justice as there was an incongruity on which court would issue the file after the two cases were consolidated.

The İstanbul Regional Court of Justice ruled to merge the Eren Erdem case with the Karşı newspaper’s case and continue prosecution in the İstanbul 23rd High Criminal Court. The first hearing of the trial was held on Sept. 27, 2018.

In the second hearing of the trial, which was held on Jan. 7, 2019, the court ruled to release Erdem. However upon the appeal of the prosecutor, the court issued another apprehension warrant for Erdem. After his release from prison, Erdem spent the night at a gendarmerie station. The next day Erdem was sent to a higher court and detained.

Erdem started a hunger strike as a protest against the violations in judicial processes on Jan. 28, 2019. He ended the strike on Feb. 5, 2019.

The court reached a verdict on March 1, 2019. Eren Erdem and Turan Ababey were found guilty of “aiding and abetting an organization knowingly and willingly, although he does not belong to the structure of that organization,” and they were each sentenced to 4 years and 2 months in prison. The court sentenced Emre Erciş for 3 years 1 month and 15 days in prison. Mehmet Bozkurt and Kutlu Esendemir were acquitted. Ababey was detained after the verdict was issued.

The Court of Appeal approved the decision at October 31st. The time he was under arrest for while waiting for a trial and the possibility of an appeal were taken into consideration and he was released.

Karşı Newspaper Trial

In 2013, there was a major corruption and bribery operation involving the names of the AKP ministers and their children. In 2014, an investigation was launched against the alleged audio recordings of suspects, which were leaked on the internet. The investigation against Eren Erdem was frozen in 2015, when he was elected as MP.

After the general elections of 2018, Erdem’s service ended and the investigation against him was relaunched.

On the same day, Eren Erdem was at the airport with his family to fly to Germany. Erdem only found out the Istanbul 35th High Criminal Court had ruled for a travel ban against him as judicial control at the passport control section of the airport.

On June 29, 2018, Erdem was taken into custody at his home in Ankara and brought to İstanbul. “I am being arrested. I don’t know the reason. The police arrested me in front of my house,” Erdem tweeted.

The reasoning for the arrest was made public only later. In the reasoning, the prosecutor’s office requested an apprehension warrant against Erdem on the grounds their was “a risk to fleeing” and the İstanbul 35th High Criminal Court accepted the request.

In his testimony in the court, Erdem said:

“They created a case with A Haber’s [a pro-government media outlet] broadcasts. If I wanted, I could have fled. If I were guilty, I would have fled. But I am not guilty and I will continue to fight. If they can prove that the FETÖ paid even a penny to the newspaper, I will ask for my own death sentence. We survived only through advertising. My crime is to write about the Dec. 17-25 investigation. In the indictment it was claimed that the newspaper was printed in the FETÖ’s printing house. It was printed in the same printing house with Aydınlık [an ultra Kemalist media outlet]. In this era, they are trying to build an empire of fear by targeting critics like me.”

After his defense, the court ruled to detain Erdem and he was sent to Silivri prison.

In the indictment, it was claimed that in his tweets, Eren Erdem had disclosed the identity of an anonymous witness called “AYÇİÇEĞİ” (“SUNFLOWER”) in the investigation against the 17-25 December corruption operation.

In addition to Eren Erdem’s testimony, the testimony of the defendants of the Karşı trial Mehmet Bozkurt, Murat Kazancu, Emre Erciş, Kutlu Esendemir and Turan Ababey were also included to the indictment.

In his testimony, Ababey, who was the anonymous witness that was allegedly revealed by Erdem said:

“One day, my relative Mehmet Gök came to me and told me that we wants to introduce me to Eren Erdem. It was the 10th month of 2013. He [Erdem] mentioned his intention of creating a newspaper. We published our first issue on Feb. 9, 2014. Eren Erdem was the Editor-in-Chief, Ufuk Köroğlu was the reporter, Mehmet Bozkurt was the Deputy of the editor-in-chief, Oğuzhan Beyaz was the senior editor, Murat Kazancı was the news director and Gülşah Karadağ was on the editorial board. But the ultimate decision maker was Eren Erdem. I created this newspaper as an investment. But later, I realised that the editorial policy of the newspaper was seized by the Congregation [The Fethullah Gülen congregation]. At that moment, I fired Eren Erdem, Ufuk Köroğlu, Emre Erciş and Nejat, the director of intelligence. I assigned Kutlu Esendemir as the editor-in-chief. The newspaper closed shortly after.”

The indictment included Ababey’s speech on the TV program called “Deşifre,” which was aired on Jan. 16, 2015 on A Haber and Erdem’s expressions on the TV program called “Ezber Bozanlar”, which was aired on Jan. 18, 2015 on Halk TV and a TV program called “Güne Bakış” which was aired on Jan. 19, 2015 in Bugün TV.

In the indictment:

  • It was claimed the alleged audio recordings of the President Recep Tayyip Erdoğan and US President Barack Obama, businessman Reza Zarrab and then Interior Minister Muammer Güler were published in the newspaper.

  • It was claimed the documents of the MIT (National Intelligence Organization) trucks that were caught transferring weapons to Syria on May 2015 were “handed” to Eren Erdem before anyone else. And it was added that Erdem and Mehmet Bozkurt discussed this document and then decided not to publish it.

  • It was claimed that while Erdem was the editor-in-chief of the Karşı newspaper, he told Ababey that “he has documents that can overthrow the then Prime Minister Recep Tayyip Erdoğan, and if they publish it, the TUSKON (Turkish Confederation of Businessmen and Industrialists) and Fethullah Gülen congregation will support the newspaper financially.”

  • It was stated the information regarding the secret meeting of then Prime Minister Erdoğan, then Foreign Minister Ahmet Davutoğlu, MIT Undersecretary Hakan Fidan, and then Deputy Foreign Minister Feridun Sinirlioğlu were covered under the headlines of “Paramzadeler” (“Sons of money”) and “Kan Lobisi” (“Blood Lobby”).

In the conclusion chapter of the indictment, the prosecutor used the following terms regarding Eren Erdem:

  • That Erdem and Turan Ababey made a deal to create a new newspaper in 2013, when the closure of FETÖ’s training centers were the top topic;

  • The Karşı newspaper, which was published after the “Dec. 17-25 coup attempt” on Feb. 9, 2014, was trying to create a perception against the government through its media power, which was used in line with the aims of the FETÖ/PDY’s (Fethullahist Terrorist Organization/ Parallel State Structure);

  • Some documents, information and audio recordings regarding some investigations were published in line with the FETÖ/PDY’s aims;

  • They tried to prevent the government from fulfilling its duties by creating a public perception against the government through the power of media;

  • Both through publications and social media posts, Erdem violated the confidentiality of the investigation by disclosing the identity of the anonymous witness called “AYÇİÇEĞİ”;

  • It was understood that Erdem was aiding and abetting the FETÖ/PDY armed terrorist organization knowingly and willingly, although he does not belong to the structure of the organization.

In the indictment, the prosecutor recommended to charge Erdem for “aiding and abetting an organization knowingly and willingly, although he does not belong to the structure of that organization” and “violating an investigation’s confidentiality by disclosing the identity of an anonymous witness” and asked for up to 22 years of prison.

The indictment about Eren Erdem was prepared by the İstanbul 35th Heavy Penal Court. The indictment about the Karşı newspaper’s owner and journalists had been accepted by The İstanbul 23rd Heavy Penal Court.

The case file had been sent to the İstanbul Regional Court of Justice as there was an incongruity on which court would issue the file after the two cases were consolidated.

The İstanbul Regional Court of Justice ruled to merge the Eren Erdem case with the Karşı newspaper’s case and continue the prosecution in the İstanbul 23rd High Criminal Court. The first hearing of the trial was held on Sept. 27, 2018.

The first hearing was focused on the apprehension warrant against Alaaddin Akkaşoğlu, the owner of the karsigazete.com news website and one of the partners of Akis Yayıncılık. The trial was held ex officio because Akkaşoğlu was already imprisoned in scope of another prosecution.

The second hearing of the trial was held on Oct. 31, 2018. In his defense, Erdem noted that he wrote a critical piece about Gülen only two days before the 17-25 December operation and said: “In the days when I wrote that critical piece, some of the MP’s of AKP were visiting Fethullah Gülen in Pennsylvania and taking photos with him. In that year, I was prosecuted for that article.”

Eren Erdem refused the accusation that they published the leaked audio recordings of the 17-25 December corruption operation. Regarding the accusation that he was in contact with TUSKON, which was allegedly affiliated with the FETÖ, he said, “As far as I know, neither I, nor any of the newspaper’s managers were contacted by the TUSKON.”

Regarding the report titled “Kan Lobisi” dated Feb. 28, 2014, Erdem said, “We have committed a crime with this report, but it was the crime of violating the publication ban.”He continued:

“We discussed whether it was newsworthy or not. On that day a lot of media outlets violated the media ban on purpose. It was a protest against the ban. It was a protest against the government’s media censorship. This was also mentioned in the report itself. If they didn’t apply the ban, we probably wouldn’t have published this story.”

Noting that if he would have obtained the MIT trucks’ documents from CHP MP Bülent Tezcan as it was claimed, Erdem said he would never have disclosed his source’s name, “ Mr. Tezcan showed these documents in his speech at the Parliament in 2014. It was public. I asked for the documents. ‘It will be a headache for you,’ he said but I said that I was curious. I wrote nothing about that file.”

At the hearing, the presiding Judge Ahmet Uğuz asked Erdem: “Why did you collaborate with the Cihan News Agency even you knew about their affiliation with the organization?” Erdem replied: “Everyone was working with them. Cihan was fulfilling a gap in the news agencies.”

Regarding the accusation that he disclosed the identity of an anonymous witness called “AYÇİÇEĞİ,” Erdem said:

“I didn’t disclose his identity. The fact that the anonymous witness was actually Turan Ababey was published in social media a long time ago. I learned it from social media. Ababey also tweeted about that and wrote ‘I was a regular witness, they made me an anonymous one’.”

Refusing the claims that he received some confidential documents through a chocolate box, Erdem said, “The people who wrote the actual report would never have accepted such a thing. The Editor-in-Chief would have never handed over CDs. It’s against the ethics of journalism.” He then asked for his release.

The court ruled for the continuation of Erdem’s arrest by a majority vote on the grounds that all the witnesses had yet to be heard and he could have an influence on the witnesses.

The judge Ali Özcan added an annotation to the verdict as follows:

“Due to the status of the evidence; the stage of the prosecution; that there isn’t any solid action that can imply the probability that Erdem might flee or hide, Erdem doesn’t display any behaviour implying he might spoil the evidence; and regarding the time he spent in prison, I do not agree with the majority vote for the arrest ruling.”

The third hearing of the trial was held on Jan. 7, 2019. Ercan Gün (a former news director of FOX TV, who is prosecuted in Hrant Dink’s murder trial), Furkan Haykır (a reporter for Sabah newspaper), Alpdeğer Tanrıverdi (a lawyer who is prosecuted for the MIT trucks incident, in which they were stopped in Adana and Hatay), Tunay Şentürk (a Twitter user allegedly providing confidential documents for Eren Erdem), Levent Üzümcü (a columnist of the Karşı newspaper and actor) and İhsan Eliaçık (a columnist of the Karşı newspaper and theologian) testified as witnesses in the hearing.

In the hearing the prosecutor Aydın Boztaş explained his opinion regarding the accusations. In a 10-page opinion, Boztaş stated “[the prosecution’s office] didn’t find a document or information that the Karşı newspaper was a project of FETÖ/PDY’s armed terrorist organization, however the organization infiltrated the newspaper.” It was also said there wasn’t any evidence of an organic tie between Eren Erdem and the organization.

For the reasoning of the accusations, the prosecutor’s claims were as follows:

“During and after the 17-25 December [operation], Erdem served the organization’s aim to gain mass support to overthrow the legitimate government by publishing documents, audio recordings and information in the newspaper and on the news website.”

Regarding this reasoning the prosecutor recommended to convict Erdem for “aiding and abetting an organization knowingly and willingly.”

The prosecutor also claimed that “By sharing the name of an anonymous witness identity as ‘Turan Ababey’ in his press conference at the Parliament, he made it easier for the public to access this information” and recommended to convict Erdem for “violating an investigation’s confidentiality by disclosing the identity of an anonymous witness.”

The court ruled to release Eren Erdem.

The prosecutor’s office appealed the release verdict of the İstanbul 23rd High Criminal Court, claiming there was a risk for him to flee. The İstanbul 24th High Criminal Court accepted the appeal and ruled for an apprehension warrant to arrest Erdem even though he had been released from prison.

Eren Erdem was sent to court on Jan. 8, 2019. The court didn’t let observers enter the courtroom. In his statement at the hearing, Edrem said: “The suspicion regarding the risk of fleeing is unnecessary. If I wanted to go, I would have left already. How could you read 56 racks of information about me to reach a verdict in such a short time? This verdict has no influence. The case has collapsed.”

The court ruled to detain Erdem once again. In its reasoning, it was stated that “ … evaluating the extent of the case, the defense of the defendant, the testimonies of the witnesses, the current evidence in the case, and regarding the defendant was caught while he was trying to flee abroad, a risk of fleeing has been found.”

The fourth hearing of the trial was held on Jan. 18, 2019.

The court reached a verdict on March 1, 2019. Kemal Özkiraz was heard as a witness in the hearing. In his testimony, Özkiraz said:

“Eren Erdem and I were together in several TV programmes and political platforms. I was with him when he was writing his books. The claim of affiliation with Fethullah Gülen’s organization is ridiculous. Two or three days after the 15th of July coup attempt, I asked to Erdem: “If this attempt would have been successful, what would happen to us” Erdem answered: “They would have killed me first, I wrote dozens of books about them”.”

In his last defense, Erdem said: “You can arrest me but please save me from these accusations with solid evidence. I am a member of two organizations. One of them is Republican People’s Party, the other one is Beşiktaş. I have never waved any other flag but Beşiktaş’. I would have never waved an organization’s flag that conflicts with my political ideology.”

Erdem continued:

“I have these principles, my stance is steady. They couldn’t prove the contrary. But, there is a serious pressure on the media. When you released me, they called you FETÖist. They called you a FETÖist. It is that cheap.”

The İstanbul 23rd High Criminal Court reached a verdict on March 1, 2019. Erdem was acquitted from the accusations of “violating the confidentiality of an investigation” and “disclosing an anonymous witness’ identity.”

The court convicted Erdem for “aiding and abetting an organization knowingly and willingly, although he does not belong to the structure of that organization” and sentenced him for 4 years and 2 months of prison. The court ruled for the continuation of Erdem’s arrest.

Onur Cingil, Eren Erdem’s attorney appealed the decision. The file was sent to the İstanbul Regional Court of Justice’s 3rd Penal Chamber.

Appeal Process

The Court of Appeal finished examining the files at October 31st. Criminal Chamber, approved the decision of the local court unanimously. Criminal Chamber, stated that there was nothing unlawful regarding the rules and procedures, there was no deficiency in the evidences and processes, in the imprisonment sentence of the local court and the evaluation regarding the proof was done accurately. The decision showed that the actions were characterised correctly and it was ruled that appeal requests were to be dismissed with prejudice.

The time he was under arrest for while waiting for a trial and the possibility of an appeal were taken into consideration and he was released. The decision stated that the route for the Court of Cassation was open. A ban on leaving the country and judicial control measures were imposed against Erdem.

5. Standing - March 1, 2019


Karşı Gazete çalışanlarına, gazetenin FETÖ’nün aracı olduğu iddiasıyla açılan dava dosyası, gazetenin eski genel yayın yönetmeni ve eski CHP milletvekili Eren Erdem’e açılan dava dosyasıyla birleştirildi. Çalışanlara açıan davanın iddianamesini Murat Çağlak hazırlamıştı. Eren Erdem için iddianameyi Fahri Mutlu Tosun hazırladı.

12 sanıklı davanın iki tutuklu sanığından biri gazeteci Eren Erdem, diğeri ise bir internet haber sitesi sahibi olan ve mesajları nedeniyle suçlanan bir sosyal medya kullanıcısı.

Davanın ikinci duruşmasında Erdem hakkında tahliye kararı verildi, ancak savcının itirazı üzerine Erdem hakkında yeniden yakalama kararı çıkartıldı. Cezaevinden çıkan Erdem, geceyi jandarma karakolunda geçirdikten sonra bir üst mahkemeye getirildi ve tutuklandı.

1 Mart 2019’daki son duruşmada mahkeme, “Silahlı Terör Örgütü Hiyerarşisine Dahil Olmamakla Beraber Bilerek ve İsteyerek Örgüte Yardım Etmek” suçlamasından Eren Erdem’in 4 yıl 2 ay, Emre Erçiş’İn 3 yıl 1 ay 15 gün hapis ile cezalandırılmasına, Mehmet Bozkurt ve Kutlu Esendemir’in beraatine karar verdi.


Ahmet Uğuz başkanlığında üye hakimler Abdullah Ok ve Emine Çakır’dan oluşan heyetin yerini almasıyla duruşma saat 11.30 civarında başladı. Saat 13.00’da verilen öğle arasının ardından 14.00’da duruşmaya devam edildi. Saat 15.42’de karar için ara verildi. Saat 18.45’te karar açıklandı.

Tutuklu sanıklar Eren Erdem ve O.K’nin salona alınmasının ardından izleyiciler salona girdi.

Duruşmaya tutuksuz sanıklardan Emre Erciş, T. A., Kutlu Esendemir katıldı.

Yoklamanın alınmasının tutuklu sanık O.K’nin etkin pişmanlık hükümlerinden faydalanmak amacı ile celse arasında verdiği beyan dosyaya eklendi.

Duruşma, Avrasya Araştırma Başkanı Kemal Özkiraz’ın Eren Erdem’in tanığı olarak dinlenmesiyle başladı. Özkiraz, dosyadaki sanıklardan Emre Erciş’in “Erdem’le husumeti olduğunu ve ona iftira attığını” dile getirdiğine iki kez şahit olduğunu anlattı. “Erciş ile ortak bir arkadaşımız vasıtasıyla aynı ortamdayken, ortak arkadaşımız Erciş’e ‘Yaptığın yazık, günah’ dedi. Erciş de dedi ki, ‘Benim onunla (Eren Erdem) hesabım bitmedi. FETÖ’cü olmadığını ben de biliyorum ama tutuklanana kadar elimden geleni yapacağım’ dedi. Bu olay 30 Ağustos’ta oldu. Bir kere de benim arabama bindiğinde aynı şeyi söyledi” diye konuştu.

Tanık Özkiraz’ın beyanı sırasında salonda bulunan Erciş müdahale ederek “Bu kişiyi ilk defa gördüm. Gazeteden ayrılmamın Erdem’le husumetten olduğunu söylüyor, bu yalan. Husumetimiz yoktu. Ben ‘Eren Erdem FETÖ’cü değildir’ diye tweet attım” dedi.
Mahkeme başkanı Uğuz, Erciş’e “sataşmayın” şeklinde uyarıda bulundu.

Ardından Erdem’e söz verdi. Erdem, Özkiraz’ın bahsettiği “ortak arkadaş”ın ismini sorarak, bu ismin tutanaklara geçmesini istedi.

Tanığın dinlenmesinin ardından mütalaası sorulan savcı Uçan, tutuklu sanıkların tutukluluk halinin devamını ve mahkeme aracılığıyla Eren Erdem hakkında MİT TIR’ları belgelerini usulsüz temin ederek ifşa etme suçlamasıyla suç duyurusunda bulunulmasını istedi.

Mahkeme suç duyurusu kararına yer olmadığına karar verdi. Mahkeme başkanı “tahliye taleplerini alalım” diyerek sanıklara sırayla söz vereceğini ifade etti.

Etkin pişmanlıktan yararlanan tutuklu sanık O.K, kendini açıklamak istediğini söyledi. Mahkeme başkanı Uğuz, savunma aşamasının sona erdiğini, varsa tahliye talebinde bulunmasını söyleyerek konuşmasına izin vermedi. Kısa bir konuşma yapan O.K., tahliyesini istedi, söz konusu davayla alakası olmadığını söyledi.

Eren Erdem, yaklaşık 45 dakikalık bir beyanda bulundu. 24. ACM’nin davaya bakan bu mahkemenin değerlendirmelerini gözardı ederek Ocak 2019’da verilen tahliye kararını bozmasını eleştirdi. Tahliyeye itiraz hakkının KHK ile yasalaştığını da vurguladı.
İddianamede hakkında delil olarak gösterilen hususlara değinen Erdem,“TUSKON’dan Yusuf” adlı bir kişinin gazeteye gelip kendisine CD bıraktığına dair iddiaya konu olan Yusuf’un varolmadığının kanıtlandığını söyledi. Beyaz TV’ye gizli tanık olarak çıkan bir sanığın “gazeteye çikolata kutularında CD geldiği” iddiasını mahkemede dile getirmediğinin altını çizdi.

Aleyhine delil olarak gösterilen tüm iddiaların arkasında gizli tanık beyanlarının olduğunu dile getiren Erdem şöyle konuştu:

“Aleyhime bir şey yok. İddianamedeki her şey ortaya çıkarıldı. Cevaplanacak bir şey kalmadı. Bana siyaseten bir ceza verilecekse, FETÖ dışında bir suçlamadan kesilsin. Beni bu ithamdan kurtarın. Başka örgütlere sokun, o örgütlerden olmadığımı kanıtlayayım. Ben hayatımda sadece iki örgütün üyesiyim; CHP ve Beşiktaş.

“Benim için tahliye kararı verdiğinizde sizin (mahkeme heyetine hitaben) için de FETÖ’cü dediler. İşte bu suçlamayı yapmak bu kadar kolay.

“Dünya Türkiye’nin yargıda hata yapmasını bekliyor. Ben bu dosyayı AİHM önünde koymak istemiyorum, ben bundan utanç duyarım.

“Mütalaada bazı sanıklar için beraat isteniyor. Buna katılıyorum. Hepsi gazetecidir. Bazıları için ise ceza isteniyor. Bu davada eylem yargılansaydı, böyle olmazdı. Benim de yargılanan bir eylemim yok.

“İddianamede gizli tanık olarak yer alan kişi, buraya gelip ‘Furkan Haykır bana telkin yaptı, bana FETÖ iftirası atmamı söylediler’ dediği halde mütalaada savcılık beyanının esas alınması isteniyor. Bu nasıl olabilir? Herkes FETÖ’ye ‘Hoca Efendi’ derken, ben terör örgütü demiştim.

“İddianamede fiziki takip, SMS vs gibi bir delil yok. Ne yapmışım? Haber yapmışım. Bu ülkenin 1 numarası, Cumhurbaşkanı CHP’ye ‘terörist’ diyor, savcıların da böyle davranması normal. MİT TIR’ları davasında casusluğu yapanlar tahliye oldu! Aydınlık gazetesi davasında beraat verilmiş çünkü Basın Kanunu’nun belirlediği 4 aylık zaman aşımı dolmuş. Gizli tanığın ifşasının da benimle bir ilgisi yok. Ben ifşa olmuş gizli tanığı haber yaparım. Bunu haber yapana değil, deşifre edene dava açılır.

“İddia makamının esas hakkında mütalaası kafa yapıyor, okudukça kafayı buluyorum. Kantinden peynir söyleyip bunu okuyorum. Ve özellikle tecrit altında tutuluyorum. Cezaevinde beni yanına çağıran bir savcı bana ‘Tecrit de zordur ha… Bu CHP’nin FETÖ’yle ilişkileri var” diyor. Bana aslında partini sat, diyor. Kimseyi satmadığım için 9 aydır içerideyim. Etkin pişmanlık safsatasından yararlanmam, ceza çıksa da gidip yatarım. Ben adalet talep ediyorum, beraatimi talep ediyorum.

“Sanıklardan Emre Erciş’e bir şey söyleyeceğim. Aramızda husumet vardır. Husumetin sebepleri de vardır.

“Bunu bir helalleşme celsesi olarak görüyorum. Beraat edersem, içeride yattığım süre için tazminat davası açmayacağımı da söylemek istiyorum. Biliyorum, birçok dosyada bunu dikkate alıyorlar. Tahliyemi ve beraatimi talep ediyorum.”

Erdem’in beyanının bitmesinin ardından salondaki izleyicilerin yarısı duruşmadan ayrıldı.
Erdem’in avukatı Onur Cingil söz aldı.

Erdem hakkındaki tek delilin gizli tanık beyanları olduğunu, ifşa olan gizli tanığın da bu beyanlarını inkar ettiğini vurgulayan Cingil, Erdem’in FETÖ’ye ilişkin kitabını, makalelerini ve tweetlerini mahkemeye sundu.

Saat 13.00’da Erdem’in pansumanının yapılması ve öğle yemeği için duruşmaya bir saat ara verildi. Saat 14.00’da duruşma tekrar başladı.

Avukat Onur Cingil, Erdem’in gizli tanığın ifşası suçunu işlemediğini söyledi.
Anayasa Mahkemesi’nin tek delil olarak gizli tanık beyanıyla yargılama yapılamayacağına dair Serdar Batur kararını (2014/15652); AİHM’in “dolaylı örgüt üyeliği” suçlamasının aşırı geniş yorumlandığına dair İmret v. Türkiye (Başvuru no. 57316/10); Castells v. İspanya (Başvuru No. 11798/85) ve Atilla Kart v. Türkiye kararlarını (Başvuru No. 8917/05) mahkemeye sundu.

Avukat Zeynel Öztürk, soruşturmanın basın savcılığında başlayıp daha sonra ağır ceza mahkemesine geldiğini belirtti, Basın Kanunu’na göre zaman aşımı dolduğu için davayla ilgili düşme kararı alınmasını talep etti.

Avukat Gülsüm Öner Yetgin, Erdem’in yengesi olduğunu söyleyerek, duygusal bir konuşma yaptı; yaşananların hukuksuz olduğunu söyledi.

Kutlu Esendemir’in avukatları Taylan Tanay, Aslı Kazan ve Serdar Laçin, Basın Kanunu’nun işletilmesi ve davanın düşmesi gerektiğini söylerken, müvekkilleri hakkında hiçbir suçlama olmadığını sadece gazete çalışanı olduğu için yargılandığını ifade etti.

Mehmet Bozkurt’un avukatı Cihan Öztugay, müvekkili hakkındaki ByLock iddiasının açığa kavuştuğunu, hakkındaki diğer iddiaları oluşturan haberlere ise müvekkilinin zaten karşı çıktığını söyledi. Müvekkilinin beraatini isterken, beraatin 253-2/B maddesinden verilmesi gerektiğini vurguladı.

Ardından tutuklu sanık O.K.’nin müdafiileri Behzat Polat, Metin Öner, Gül Simge Yılmaz sırayla söz aldı. O.K’nin gazeteci olmadığını ve bu davayla alakası olmadığını söylerken, dosyasının ayrılmasını ve tahliyesini istedi.

T.A’nın avukatı Cihat Duman, müvekkilin suç işlediği sabit olmaması yönünden beraat talep etti.
Emre Erciş müdafii Nejat Özdemir de beraat talep eti.

Ardından mahkeme başkanı tüm sanıklara son sözünü sordu. Hepsi beraat talep etti.
Kutlu Esendemir’in son söz olarak “Mahkemeden hiçbir talebim yoktur” demesi üzerine, mahkeme başkanı Uğuz da “Bizim de size bir diyeceğimiz yok” dedi.

Son sözlerin alınmasının ardından, karar için mahkemeye ara verildi.

2- Tutuklu sanık O.K.hakkında yargılamanın yeni esas üzerinden yürütülmesine ve tutukluluk halinin devamına,

3- Mehmet Bozkurt ve Kutlu Esendemir’in beraatine ve haklarındaki adli kontrol tedbirinin kaldırılmasına,

4- Emre Erciş’in “Silahlı Terör Örgütü Hiyerarşisine Dahil Olmamakla Beraber Bilerek Ve İsteyerek Örgüte Yardım Etmek” suçundan alt sınırdan 5 yıl hapis ile cezalandırılmasına; cezada yapılan indirim ve arttırımlarla neticede 3 yıl 1 ay 15 gün hapis ile cezalandırılmasına

5- T.A’nın “Silahlı Terör Örgütü Hiyerarşisine Dahil Olmamakla Beraber Bilerek Ve İsteyerek Örgüte Yardım Etmek” suçlamasından alt sınırdan 5 yıl hapis ile cezalandırılmasına; cezada yapılan indirim ve arttırımlarla neticede 4 yıl 2 ay hapis ile cezalandırılmasına ve hükümle birlikte tutuklanmasına

6- Eren Erdem’in “Soruşturmanın Gizliliğini ihlal Etmek” ve “Gizli Tanığın İfşası” suçlamalarından beraatine, “Silahlı Terör Örgütü Hiyerarşisine Dahil Olmamakla Beraber Bilerek Ve İsteyerek Örgüte Yardım Etmek” suçundan alt sınırdan 5 yıl hapis ile cezalandırılmasına; cezada yapılan indirim ve arttırımlarla neticede neticede 4 yıl 2 ay hapis ile cezalandırılmasına ve tutukluluk halinin devamına,

7- Tüm sanıklar bakımından elde edilen dijital materyallerin imajlarının dosyada delil olarak saklanılmasına, cihazların sanıklara iadesine karar verildi.


Duruşma Öncesi

Duruşma öncesi mahkeme salonu önünde, avukatlar, sanık yakınları ve CHP’lilerden oluşan 30-40 kişilik bir kalabalık vardı.

Güvenlik, sadece milletvekillerinin ve avukatların turnikeyi geçerek mahkeme salonu önünde duruşmayı beklemesine izin verdi. Güvenlik görevlilerinden biri “mahkeme başkanının kimsenin alınmaması yönünde talimatı olduğunu, basın için özel bir uyarıda bulunmadığını ancak ‘basının alınmaması talimatının her zaman geçerli olduğunu’” söyledi.

Saat 11.00’da turnike açıldı.

Mahkeme Salonu Koşulları

Salonda izleyiciler için yaklaşık 30-35 kişilik oturma alanı bulunuyordu. 10-15 kişi duruşmayı ayakta izledi.

Duruşmaya Katılım

Çeşitli dönemlerden CHP milletvekilleri Barış Yarkadaş, Mahmut Tanal, Melda Onur, Ali Şekerci, Sera Kadıgil duruşmayı takip etti.

Sanık yakınları ve CHP’lilerin yanısıra, Medya ve Hukuk Çalışmaları Derneği (MLSA) ve P24 gözlemcileri duruşmadaydı.

Genel Gözlemler

Mahkemede görülen tek duruşma olmasına rağmen, duruşma öngörülen saatten (10.00) 1,5 saat gecikmeli başladı.

İzleyiciler saat 11.10’da mahkeme salonuna alındı, heyet ise 11.25’te salona girdi.

Duruşma boyunca iki güvenlik görevlisi ve sekiz jandarma salonda bekledi.

Saat 15.45’te karar için ara veren heyet, 1,5-2 saat içinde kararı açıklayacağını belirtti. İki saat sonra kararın 18.45’te açıklanacağı duyuruldu.

Saat 16.30 civarında, üzerlerinde “polis” yazılı yelekler olan sekiz polis mahkeme salonunun önüne gelerek beklemeye başladı. Bu polisler, saat 19.00’da kararın açıklanmasının ardından T.A’i tutuklayarak cezaevine götürdü.
